Peak Physiques offers Premium Online Coaching, meticulously designed to guide you toward your peak physique. Our services include custom workout routines, tailored nutrition plans, and comprehensive wellness coaching. For full service details, terms, and limitations, please refer to our website and our comprehensive coaching agreement, which clients review and agree to upon sign-up, and further confirm with an individualized agreement.
User Responsibilities
By engaging in Premium Online Coaching with Peak Physiques, the Client agrees to the following responsibilities:
Age Requirement: The Client must be at least 18 years of age.
Accurate Information: To enable effective and safe coaching, the Client is responsible for providing accurate and complete personal, health, and medical information, including any pre-existing conditions, injuries, or concerns, and must inform Peak Physiques of any changes immediately.
Medical Clearance: The Client is responsible for obtaining any necessary medical clearance from their healthcare provider prior to commencing or continuing any exercise or nutrition program recommended by Peak Physiques.
Safe Training Environment: The Client is solely responsible for ensuring a safe and appropriate training environment, proper use of equipment, and correct exercise form to prevent injury.
Program Adherence: For optimal results and safety, the Client agrees to diligently follow all provided program instructions, guidelines, and recommendations.
Timely Communication: The Client is responsible for timely communication regarding check-ins, progress, challenges, or any health-related concerns.
Technical Requirements: The Client is responsible for maintaining the necessary internet access and equipment required for online coaching sessions and program access.
Payment Terms
Fees for services are charged on a monthly recurring basis via Stripe, commencing from your program sign-up date, which acts as your monthly payment anchor date. This anchor date can be updated upon request. Your subscription will automatically renew each billing cycle unless explicitly canceled by the Client. All fees are stated in Canadian Dollars (CAD) and are exclusive of applicable taxes unless otherwise specified.
Clients are responsible for any applicable GST/HST or other local taxes based on their billing address. In the event of a missed or late payment due to an issue with the Client's payment method, service may be suspended and access to materials may be revoked until the payment issue is resolved. Peak Physiques reserves the right to modify its pricing, and Clients will receive a minimum of 30 days' notice of any such changes to their existing subscription.
Client Commitment, Cancellation & Refund Policies
Client may cancel their monthly subscription by providing 7 days' notice prior to the next billing cycle to ensure a successful off-boarding experience.
A 30-day, no questions asked refund period is offered from your program sign-up date. Contact [email protected] for refund requests if unsatisfied within this 30-day period. Beyond these 30 days, all payments are non-refundable due to the custom program, immediate intellectual property provision, and ongoing 24/7 support. No refunds will be issued beyond this satisfaction guarantee period.
To achieve optimal results and maximize your transformation, a minimum 12-week coaching commitment (including the initial 30 days) is strongly recommended. Enough dedicated time together is crucial for sustainable progress and your success.
Upon cessation of coaching, programs are not hosted online; Client must save their program. Roster space is maintained until payments are canceled. Due to limited openings, payment cancellation may result in forfeiture of the Client's dedicated roster space at Peak Physiques' sole discretion.
If Peak Physiques is unable to perform duties due to unforeseen circumstances beyond its control (e.g., illness, emergency, natural disaster), we will make every reasonable attempt to continue coaching support or reschedule scheduled check-ins and program delivery.
Intellectual Property
All content provided by Peak Physiques, including but not limited to individualized workout plans, nutrition guidance, videos, articles, and any other program materials, remains the exclusive property of Peak Physiques and is protected under applicable Canadian intellectual property laws.
The Client is granted a limited, non-transferable, and revocable license to use these materials solely for their own personal fitness use. Any unauthorized use, reproduction, distribution, or commercial exploitation of the materials for purposes other than the Client's personal fitness is strictly prohibited and may result in legal action.
Liability and Disclaimer
By participating in Premium Online Coaching with Peak Physiques, the Client acknowledges and agrees to the following:
No Medical Advice: Peak Physiques, including its coaches and staff, provides services for educational and motivational purposes only. Our coaching is not a substitute for professional medical advice, diagnosis, or treatment. The Client is solely responsible for obtaining any necessary medical clearances and consulting with their healthcare provider regarding their health or any medical conditions.
Assumption of Risk: The Client understands that engaging in physical activity and making dietary changes carries inherent risks, including but not limited to injury, illness, or aggravation of pre-existing conditions. The Client voluntarily assumes all risks associated with their participation in any recommended programs.
No Guarantees: While Peak Physiques provides evidence-based guidance and support, we do not guarantee specific fitness results, weight loss, muscle gain, or any other physical outcomes. Results are highly individual and depend on various factors including, but not limited to, the Client's genetics, adherence to the program, effort, consistency, diet, and overall health status.
Limitation of Liability: Peak Physiques accepts no liability for any injuries, health complications, financial losses, or damages incurred by the Client directly or indirectly resulting from the Client's participation in our training programs or reliance on information provided, except where prohibited by law.
Reliance on Client Information: Peak Physiques relies on the accuracy and completeness of the information provided by the Client. We accept no liability for outcomes or complications arising from inaccurate or incomplete Client information.
Technology Disclaimer: Peak Physiques is not liable for any service interruptions or failures due to internet connectivity issues, equipment malfunctions, or other technological limitations outside of Peak Physiques' direct control.
Privacy Policy
Peak Physiques is committed to protecting your privacy and personal data in strict adherence to Canadian data protection laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).
We collect, use, and store your personal data (including contact, health, and payment information) solely for the purpose of providing and improving your Premium Online Coaching services, communication, and billing. User Conduct
By using Peak Physiques' services and website, the Client agrees to adhere to the following standards of conduct:
Lawful Use: The Client must use our services and website solely for lawful purposes and in compliance with all applicable local, provincial, national, and international laws and regulations.
Prohibited Activities: The Client must not engage in any misuse of the services or website, including but not limited to:
1. Harassment, abuse, hate speech, discrimination, or any form of offensive communication towards Peak Physiques staff or other clients (if applicable in a community setting).
2. Spamming, sending unsolicited commercial communications, or transmitting harmful content (e.g., viruses, malware).
Attempting unauthorized access to our systems or other users' accounts.
3. Disrupting the integrity or performance of our services or website.
4. Sharing account credentials or individual program materials with unauthorized individuals.
Respectful Interaction: In any interactions facilitated by Peak Physiques' platform or services (including calls, messages, and any community forums), the Client is expected to maintain a respectful, professional, and constructive demeanor.
Consequences of Violation: Violation of these conduct standards may, at Peak Physiques' sole discretion, result in the immediate suspension or termination of services, forfeiture of any remaining program fees, and potential legal action.
SMS Communications and Opt-Out
You can cancel the SMS service at any time. Simply text "OUT" to the shortcode. Upon sending "OUT," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, contact us directly, and we will resume sending SMS messages to you.
Amendments to Terms
Peak Physiques reserves the right to update, modify, or replace any part of these Terms of Service at its sole discretion, at any time.
Notice of any amendments will be communicated to the Client via our website, direct email, or other appropriate means.
It is the Client's sole responsibility to review these Terms periodically for changes. By continuing to access or use our services after any amendments become effective, the Client signifies their acceptance of the revised Terms.
Governing Law and Jurisdiction
These terms are governed by the laws of the Province of Saskatchewan and the applicable laws of Canada. Any disputes will be subject to the exclusive jurisdiction of the courts of Saskatchewan, Canada.
